1. PURPOSE OF THE AGREEMENT
SAMART LUX CAR, hereafter referred to as “the Lessor” provides the client, hereafter referred to as “the Lessee” with the vehicle described in the rental agreement, subject to these terms and conditions.
2. ELIGIBILITY REQUIREMENTS
2.1. Minimum Age : 20 years old.
2.2. Valid Driver’s License : Must be held for at least 2 years (for luxury vehicle categories).
2.3. Required Documents: :
- Valid national ID or passport.
- Original driver’s license.
- Security deposit (credit card hold or bank guarantee check).
3. RENTAL DURATION & PRICING
Rentals are calculated per 24-hour period (exceeding 2 hours incurs an additional full day).
3.2. Included in Rates:
- Third-party liability insurance (as per Moroccan law).
- 24/7 roadside assistance.
3.3. Excluded : Fuel, traffic fines, tolls, and excessive cleaning fees.
4. PAYMENT & SECURITY DEPOSIT
4.1. Security Deposit : Amount varies by vehicle (blocked on credit card).
4.2. Accepted Payment Methods Credit card (Visa/Mastercard), cash (limited to 10,000 MAD), or bank transfer.
5. INSURANCE & LIABILITY
5.1. Basic Coverage: :
- Collision damage (deductible applies based on vehicle).
- Theft (subject to immediate police report).
5.2. Exclusions : - Damage to tires, windows, or interior due to negligence.
- Off-road use without written authorization.
6. VEHICLE USE
Strict Prohibitions: :
6.1. Driving under the influence of alcohol/drugs (violates Moroccan Law No. 19-12).
6.2. Transporting illegal goods or paid passengers (e.g., undeclared ride-sharing).
6.3. Crossing Moroccan borders without written approval.
7. VEHICLE RETURN
7.1. Return to agreed location and time (late return = 10% daily rate per extra hour).
7.2. Vehicle Condition :
- Fuel level must match pickup state (refueling fees apply otherwise).
8. TERMINATION OF AGREEMENT
The Lessor may terminate the agreement immediately if:
- The Lessee provides false information.
- Violates usage terms.
- Fails to honor payment obligations.
9. DISPUTES & APPLICABLE LAW
9.1. Any dispute shall be brought before the Moroccan courts.
9.2. Governing Law: Moroccan Consumer Code (Dahir 1-93-147) and Code of Obligations and Contracts.
10. DATA PROTECTION
Per Moroccan Law 09-08 on personal data protection, Lessee’s information is used solely for rental management.
